To make a public liability claim, you need to prove that the person or entity who caused your injury owed you a duty of care, breached that duty of care, and caused you harm as a result. You also need to comply with the time limits for filing your claim. In NSW, you generally have three years from the date of the accident to start legal proceedings. However, there are some exceptions and extensions that may apply depending on your circumstances.

What kind of injury compensation can I claim?

  • Lost income – the amount of income you’ve lost due to being unable to work, or operate your business, as a result of the injury. Also an amount for what you now may be unable to earn in the future.
