What is Workers Compensation in NSW?

If you have suffered a workplace injury in NSW, you may be entitled to make a NSW workers compensation claim and a work injury damages claim. The Workers Compensation scheme in NSW is now managed by iCare (previously WorkCover). The workers compensation is a system that provides financial support and medical treatment for workers who suffer work-related injuries or illnesses. Whether you have a physical or psychological injury, or a pre-existing condition that has been aggravated by your work, you may be eligible to claim.

However, claiming workers compensation can be a complex and stressful process. You may face challenges from the insurer and need to take the claim to the Personal Injury Commission (PIC). The PIC is the independent Commission that resolves disputes about workplace injuries in NSW. You may also have questions about your rights, entitlements, and obligations under the workers compensation scheme.

What are my workers compensation entitlements?

Weekly Payments (Income Support) – Check our workers’ compensation page for information on weekly payment coverage.
Medical Coverage – If your psychological injury requires treatment from healthcare providers, and the recommended treatment is reasonably necessary due to the workplace injury, you may have coverage. Refer to our workers’ compensation page for detailed information.
Lump Sum Compensation – If you have a significant and ongoing psychological injury that isn’t improving with treatment and you remain unfit for work, you may be eligible for a lump sum claim. For psychological injuries, you need to be agreed upon or certified with at least 15% Whole Person Impairment (WPI) to receive a lump sum entitlement.
Work Injury Damages: – If you’re certified or agreed upon with 15% WPI and your psychological injury results from workplace negligence, you might have a negligence claim against your employer. Contact our workers’ compensation lawyers to discuss whether you have a work injury damages claim.

Legal Costs

ILARS Grant – If you are employed and/or work in New South Wales, have sustained an injury you may be able to have your legal fees covered by the Independant Review Office (IRO). If your claim meets the IRO guidelines, you may be eligible for an ILARS grant which covers your reasonable legal fees and disbursements. Contact us to see if you are eligible. Exceptions do apply, see below.
Workers Compensation (exempt workers) – If you are employed and/or work in an exempt category for worker (Police Officer, Firefighter, Ambulance Officer) in New South Wales, have sustained an injury you may be able to have your workers compensation lawyer’s legal fees covered on a “no win, no fee” basis. ILARS grants do not cover exempt workers.
Work Injury Damages Claims – If you meet the criteria for a Work Injury Damages claim (negligence claim) you may be able to have your legal fees covered on a “no win, no fee” basis, otherwise known as a conditional cost agreement. Read here for more information about Work Injury Damages claims.
